Former Ukhozi FM presenter Ngizwe Mchunu is expected to apply for bail at the Randburg Magistrates Court on Wednesday.
Mchunu is one of the alleged instigators of the public violence in KwaZulu Natal and Gauteng.
He handed himself to the police last week and has remained in custody.
The staunch supporter of former president Jacob Zuma recorded videos of himself telling the president and Acting Chief Justice Raymond Zondo to release Zuma.
He also addressed his supporters urging them to rally behind Zuma.
The NPA told the court that Mchunu used a private jet to fly from Durban to Johannesburg making him a flight risk.
